Acceptable Use

Unless otherwise specified below, Bitmixers abides by the Acceptable Use Policy as provided by the colocation facility.

Bitmixers reserves the right to take whatever actions we deem appropriate to enforce these policies. We also reserve the right to change these policies without prior notice at any time. The actions we take may include account suspension or termination. We do not issue any credits for accounts cancelled due to policy violations. We reserve the right to refuse service to anyone at any time for any reason.

Bitmixers reserves the right to take whatever measures it deems necessary to secure its networks and clients against abuse. This includes, but is not limited to: scanning for open mail relays, virus filtering, etc. Policy will apply to any activity which affects or mentions a Bitmixers account, user, network, or server.

Bitmixers reserves the right to take legal action against anyone who abuses our network, servers, or services. Fees may also be levied at $100 per incident and per hour to help cover systems administration costs related to an incident.

All subscribers are expected to read and abide by Bitmixers' Service Agreement since, "Use of Bitmixers LC services by you as a company and/or an individual constitutes acceptance of these Terms and Conditions in full."

Billing

Bitmixers bills for all services in advance. Accounts are suspended 7 days after their due date if payment is not made. Invoices are sent via email. Bitmixers notifies clients an account is due on three separate occasions:

  1. with the original invoice (typically 14 days before account comes due)
  2. the day the account is due
  3. the day before the account will be suspended

Bitmixers accepts the following forms of payment: cash, checks, and PayPal payments made to the Bitmixers LC PayPal Account: support@bitmixers.com. If clients have any questions about billing, they can contact our billing department by email at billing@bitmixers.com. Bitmixers clients are bound by the Uniform Consumer Credit Code of the State of Utah. Payments by any client indicate full acceptance and understanding of your obligation, at invoiced service levels, under the terms and conditions of the Master Service Agreement.

Bounced check payments

There will be a $20 fee assessed on all returned checks.

Refund / Account termination

Any customer terminated account is subject to a pro-rated refund of the unused portion of your service. Accounts cancelled by Bitmixers for policy violation are NOT subject to refund and penalty fees may apply.

Purged Accounts

After 45 days of non-payment Bitmixers accounts are purged from the system. That means that any and all information in the client directory is purged, including email, Web, FTP, and any extraneous files located on Bitmixers. Bitmixers does not keep archives of purged accounts.

Mail and WWW forwarding options

Subscribers moving to a new Internet Service Provider are recommended to continue their accounts on Bitmixers for an additional month beyond transfer of information to the new ISP for forwarding purposes. If you need your site to forward longer simply pay for the amount of time you need your mail and WWW pages forwarded.

Maintenance Policy

All scheduled systems maintenance will be performed during approved maintenance window times.

Approved maintenance window times:

  • For critical systems (requiring server reboot/recycle): between 11pm-6am MST
  • For non-critical systems (service, application, systems restarts): outside of business hours, preferably between 6pm-8am MST
